pedestrian vs mta bus accideent resulting in amputation
This was a tragic accident that occurred at the intersection of Alvarado and 8th Street
in Los Angeles at approximately 5:00 p.m. At the time of the incident, Plaintiff was
crossing from the southeast corner walking northbound in a marked cross-walk controlled
by a tri-light signal and pedestrian walk box.
Defendant driver was an employee of the Los Angeles County Metropolitan
Transportation Authority (MTA) in the course and scope of his job operating a MTA bus
that was out of services and not carrying passengers. Defendant was eastbound on 8th
Street at the time of the accident.
Plaintiff was crossing from the corner and took approximately 4 to 6 steps and was
hit in between the number 1 and number 2 eastbound lanes of 8th Street by the bus. The
impact resulted in severe injuries including the amputation of his left leg at the knee level.
Defendant claims he entered the intersection on a solid green light and that he saw
the pedestrian walk signal illuminated for his direction of travel. Plaintiff had no memory
of the accident or events immediately before or after.
One witness testified that the Defendant bus driver entered the intersection on a red
light.
Numerous independent witnesses including an emergency medical technician
whose emergency vehicle was stopped in the cross walk when the accident occurred
testified that Plaintiff entered the crosswalk on a red light.
